The order status is updated continuously as and when changes occur during the processing of the order. The Customer is required to review the “Order Submission Confirmation” and immediately inform the COMPANY (within a maximum period of 2 hours from the time of receipt of the electronic notification marked as “Order Submission”) in writing of any errors, otherwise the details mentioned in the “Order Submission Confirmation” will be applied to the Sales Agreement.During the processing of each registered order, the availability stock for the products ordered is confirmed. If a price error is found in respect of only some of the products ordered, the order shall remain valid and shall be executed properly in respect of the remaining products, while it shall be deemed not to have been concluded in respect of the products in which the error was found, except where the products included in the order are related, are intended to be used as a whole and operate together as a single unit, and the Customer declares that partial fulfilment of the order does not meet their needs or serve their interests, in which case the COMPANY shall be required to cancel the entire order. Any payments initiated or already executed shall be cancelled/ Any payments shall be refunded to the customer without undue delay, using the same method that the customer chose to make the payment. In the event of an incorrect shipment of products or services that were not ordered, their unconditional receipt or the failure to inform the COMPANY and return the products cannot be considered as consent, acceptance, or a declaration of intent to purchase them. Product AvailabilityThe Customer is informed about the availability of the products through indications provided on the page of each product or service on the online store. The COMPANY reserves the right regarding the availability of its products should they not be available at the time of the order. In any case, the COMPANY undertakes to deliver the product ordered within thirty (30) days from the confirmation of the order receipt. However, the COMPANY reserves the right to notify the Customer in the event that circumstances arising subsequently render the product unavailable, or of a possible (new) delivery time if there are reasons for a delay in delivery. In this case, if the Customer deems that the delay renders the transaction no longer worthwhile, they shall be entitled to unilaterally cancel the order by a written statement (via email to info@hpshop.gr). Once the order has been cancelled and the sale agreement has therefore been terminated, the COMPANY shall be required to refund, without undue delay, all money paid to it by the Customer.Unavailability of part of an order: If only a part of the products ordered are unavailable, the remainder of the order shall be properly executed, unless the products of the order are related and are intended to be used as a whole, and the Customer declares that the partial execution of the order does not meet their needs or serve their interests, in which case the COMPANY shall be required to cancel the entire order.4. Shipping Terms and Conditions - Order Delivery4.1. Place of DeliveryDelivery to the place specified by the Customer: If the product is sent to the place chosen by the Customer, the product shall be delivered to an external partner - carrier, and the Customer shall be informed electronically that the product is ready for shipment. The Customer, not the COMPANY, shall be liable for any incorrect information entered by the Customer or for any resulting incorrect calculation of shipping costs. To receive the order, the Customer must show the external partner-carrier the order confirmation (order code) and the shipment notification as well as an official document verifying their identity (such as police identity card or passport). In the event that the partner-carrier cannot find the Customer to deliver the order, the order shall be delivered to any cohabitant. If the Customer wishes to authorise a third party to collect their order, then the authorised third party must present a specific authorisation to collect the order in question, duly certified by a Citizen Service Centre (KEP), the police or another Authority, as well as an official document necessary for identity verification (police identity card, passport, etc.).In view of the fact that after the receipt of the products, the risk passes to the Customer, the latter must inspect the products upon delivery, since, by signing upon receipt, they confirm that they have correctly received the products ordered. If the Customer fails to collect the product after receiving the shipment notification and despite the relevant notification from the carrier, the COMPANY reserves the right to withdraw from the sale.4.4. Transportation costs:Shipping costs for orders depend on the weight and the place of delivery. Therefore, provided that the delivery of the order is possible and the delivery is not to an excluded area, the following charges shall apply for product deliveries within the Greek territory:In the event that the delivery of the order is extremely difficult or impossible, the Customer shall be informed accordingly upon the finalisation of the order.4.5. Such events may indicatively include strikes, terrorist acts, acts of war, floods, wildfires, supplier/transportation/production problems, fluctuations in the currency exchange rates, governmental or legislative acts and natural disasters. If such events persist for more than two (2) months, the sale agreement may be terminated by either contracting party without any compensation. Transaction security and compliance are ensured in accordance with the PCI-DSS standard. Any products delivered shall remain the property of the COMPANY until the purchase price has been paid finally, fully, and in its entirety.6. Claims arising from defects or lack of agreed feature6.1. Seller's liability for actual defects or lack of agreed featuresIn the event that the COMPANY is liable for the lack of conformity of the item ('legal warranty'), the Customer is entitled, at their discretion: a) to demand, without charge, the repair or replacement of the product with another product, unless this is not possible or, compared to the remedy not selected, it entails disproportionate costs for the seller, taking into account in particular the value of the item, the severity of the lack of conformity, and the possibility of completing the remedy not selected without significant inconvenience to the buyer; b) to request a price reduction; c) to withdraw from the sale agreement; or d) to request compensation. If the Customer opts for product repair or replacement, the COMPANY must proceed with such repair or replacement within a reasonable period of time. The Customer shall be entitled to reduce the price or, in case of a material lack of conformity, to withdraw from the agreement, only if: The Company either lawfully refuses to remedy the lack of conformity (i.e., either repair or replacement) or it states, or it can be inferred from the circumstances that it will not remedy the lack of conformity fully and properly, 2. The Company fails to remedy the lack of conformity fully and properly, 3. despite the Company's attempt to remedy the lack of conformity, the same or a different lack of conformity occurs again, 4. the lack of conformity is so serious as to justify an immediate price reduction or withdrawal, 5. the lack of conformity becomes apparent within thirty (30) days of the delivery of the item and the Customer has notified the Company of the lack of conformity without undue delay. The above statutory rights of the Customer shall be time-barred upon the expiry of two years. Supplier’s Liability and WarrantyNew products with a long lifespan (“durable goods”) must be accompanied by a warranty (“commercial warranty”) by the product manufacturer or the enterprise that imported the product in the EU, or the entity indicated as manufacturer (“Supplier”). The basic terms of the commercial warranty are as follows:(a) The Supplier is obliged to provide the Customer in writing and in the Greek language or with internationally established symbols, clear and complete instructions for the safe use, storage, maintenance, and full utilisation of the product, and information on the risks associated with its use and storage. The warranty must include, in simple, legible, and understandable wording in the Greek language, at least the name and address of the guarantor, the product to which the warranty relates, its exact content, its duration, and the extent of its territorial validity. The warranty must be in accordance with the principles of good faith and must not be undermined by excessive exclusion clauses. The duration of the warranty must be reasonable in relation to the time during which such products are expected to remain technologically current, if that period is shorter than their expected lifespan. (b) If a defect appears in the product during the warranty period and the Supplier refuses or delays the repair beyond the necessary time in each case, the Customer is entitled to request the replacement of the product with a new one of the same characteristics and quality or, if it cannot be repaired, to request withdrawal from the contract. If the required repair time exceeds fifteen (15) working days, the Customer is entitled to request the temporary replacement of the product for the duration of the repair. Any breach by the Supplier of its obligations shall not affect the validity of the warranty, which the Customer may invoke and require the Supplier to uphold. (c) In addition to the warranty, the Supplier of new durable consumer goods must ensure the continuous provision of technical services to Consumers for the maintenance and repair of such goods for a period equal to their expected lifespan. The products made available by the COMPANY are accompanied by written instructions for use and by a written warranty of good performance of a reasonable duration, in the Greek language. The warranty document shall always include the name and address of the manufacturer, the product to which the warranty relates, its exact content, its duration, its territorial validity, as well as the rights provided by applicable law. The COMPANY, insofar as it is a Supplier in accordance with the above, shall include with its long-life products the terms governing their safe use and maintenance, with which the Customer is obliged to comply. The warranty for every durable consumer product is valid, according to the manufacturer, from the date of purchase and provides for the free remedy of the problem, provided that: a) the agency warranty and the proof of purchase of the device exist, b) the fixed elements of the device (Serial No.) have not been altered, and c) the fault is not excluded based on the manufacturer's warranty document.7.
